Rules, Waiver, Release of Liability, Conditions

_{Rules and Conditions}  

• ^{Appropriate covered footwear and a shirt must be worn at all times while using the facility.}
• ^{All equipment must be wiped down with provided spray and towel, and put back after use.} 
• ^{No metal plates are allowed to be used for deadlifts or any ground barbell lifts.}
• ^{Drug use is not permitted and will not be tolerated at any MTC Iwikua location or event. Any member found using, possessing, or providing drugs will result in forfeiture of membership effective immediately.}
• ^{Each member must respect other gym users and behave in an appropriate manner at all times.}
• ^{Membership is not refundable, transferable, or shareable.}
• ^{MTC/Iwikua staff reserves the right to rescind the rights of members not complying with the terms and conditions of membership.}
• ^{I have read the above stated gym rules}

_{Express assumption of risk I, the undersigned, am aware that there are significant risks involved in all aspects of physical training. These risks include, but are not limited to: falls which can result in serious injury or death; injury or death due to negligence on the part of myself, my training partner, or other people around me; injury or death due to improper use or failure of equipment; strains and sprains. I am aware that any of these above mentioned risks may result in serious injury or death to myself and or my partner(s). I willingly assume full responsibility for the risks that I am exposing myself to and accept full responsibility for any injury or death that may result from participation in any activity or class while at, or under direction of Iwikua Makana Training Center. I acknowledge that I have no physical impairments, injuries, or illnesses that will endanger me or others.} 

_{Release and Indemnity I participate in the activity at my sole risk and responsibility. release, indemnify, and hold harmless Makana Training Center Iwikua, its servants and agents, from and against all and any actions or claims which may be made by me or on my behalf or by other parties for or in respect of or arising out of any injuries, loss, damage, or death caused to me or my property whether by negligence, breach of contract, or in any way whatsoever.}
